Terms and Conditions Effective Date: July 2024

These Terms and Conditions (“Terms”) govern your use of the services provided by WP Care Co. (“we,” “us,” “our”). By engaging with our services, you agree to abide by these Terms. Please read them carefully.


1. Services Offered

WP Care Co. provides the following WordPress maintenance services:

  • Website Updates: Regular updates for WordPress core, plugins, and themes.
  • Backups: Scheduled weekly backups of your website to ensure recovery in case of data loss.
  • Monitoring: Ongoing security monitoring to detect and prevent potential threats.
  • Optimization: Performance optimization, including image compression, caching, and site speed improvements.

These services do not include the addition of new website content, design changes, or custom development. Any support beyond the standard maintenance is available upon request and billed at our standard hourly rates.


2. Payment Terms

We offer subscription-based services, and payments are processed through South African payment merchants. Payments via Electronic Funds Transfer (EFT) are accepted upon request. One month’s fee is charged in advance at the start of each billing cycle.

Clients are required to provide 30 days’ notice for cancellations. Any cancellations made without this notice will result in the following month being charged in full.

Refund Policy: WP Care Co. does not offer refunds for any services, including instances where a client changes their mind or decides to discontinue the service before the end of the billing period. All payments made are final.

Failure to pay on time may result in suspension or termination of services. We reserve the right to cancel any ongoing maintenance for accounts that are in arrears or where there has been non-compliance with these Terms.


3. Support and Service Guarantees

We guarantee timely support for issues within the scope of our services. Support inquiries will be handled within a reasonable timeframe, and specific response times will be communicated for individual cases. Weekly updates and backups are provided as part of our standard maintenance package.


4. Client Responsibilities

Clients are responsible for providing accurate and up-to-date information, including login credentials necessary for us to perform maintenance tasks. You agree to ensure that all information provided to us is correct and not misleading.

You must also ensure the security of your own credentials. WP Care Co. is not liable for any issues arising from unauthorized access due to the client’s negligence.


5. Limitation of Liability

WP Care Co. is not responsible for:

  • Data loss due to issues outside our control, such as incompatible or third-party plugins and themes, or unforeseen technical problems related to these.
  • Damages arising from major cybercrimes or external attacks that occur despite our security measures.
  • Service interruptions or delays caused by factors beyond our reasonable control, such as internet outages, hosting issues, or client negligence.

In no event shall WP Care Co. be held liable for indirect, incidental, or consequential damages, including loss of profits or data.


6. Cancellation and Breach of Contract

In the event of non-payment, providing false information, or misuse of services, WP Care Co. reserves the right to cancel services. Upon cancellation, we may pursue any legal remedies available to recover outstanding amounts or address breaches of contract, including submission of the case to our legal counsel.


7. Jurisdiction and Governing Law

These Terms and any disputes arising from the services provided by WP Care Co. are governed by and construed in accordance with the laws of South Africa. By using our services, you consent to the exclusive jurisdiction of South African courts.


8. Dispute Resolution

In the event of a dispute, WP Care Co. will make reasonable efforts to resolve the issue through mediation, arbitration, or litigation, as necessary. All parties agree to first attempt to resolve disputes amicably before escalating to formal legal proceedings.


9. Data Collection and Privacy

WP Care Co. collects normal client data, including personal identification details (such as name, email, phone number) and technical information required for the services we provide. This data is handled in accordance with our [Privacy Policy], which complies with the Protection of Personal Information Act (POPIA).

We take reasonable steps to protect your data but cannot guarantee absolute security, particularly in cases of unauthorized access beyond our control.


10. Changes to Terms

We reserve the right to update these Terms at any time. Any changes will be posted on our website, and continued use of our services following such updates constitutes acceptance of the revised Terms.
